Terms of Service
Effective date: 10 August 2026
These Terms of Service (“Terms”) govern your use of the ToolkitHQ website at toolkit-hq.com (the “Site”), operated by Thomas William Diego Asenjo (ABN 25 303 258 251), an individual sole trader trading as ToolkitHQ, from Victoria, Australia. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Use of the Site
The Site is a portfolio of free and freemium calculators and tools covering finance, health, math, business, and home improvement. Use is anonymous — no account is required.
You agree to:
- Use the Site for personal, non-commercial purposes.
- Not misuse, scrape at scale, overload, or attempt to disrupt the service.
- Not attempt to reverse-engineer, bypass paywalls, or redistribute premium features.
2. The tools are informational, not professional advice
This is the most important section. Please read it carefully.
- Health calculators (TDEE, BMR, BMI, macro) are not medical advice. They provide estimates from published formulas and do not replace a qualified health professional. Do not make medical decisions based solely on these tools.
- Financial calculators (auto loan, lease-vs-buy, sales tax, salary converter, child support) are estimates only and not financial or legal advice. The child support calculator is explicitly a planning estimate and not a court figure — verify against your state’s official calculator before relying on any result.
- The roofing cost calculator is a planning range and not a contractor’s bid. Actual quotes may vary 20–30% in either direction.
- The invoice generator produces a document from data you enter. ToolkitHQ is not a party to any invoice created and accepts no responsibility for the accuracy or legality of invoices generated by users.
3. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable law that may not be lawfully excluded.
Where our liability may be limited, our liability for any loss or damage arising from use of the Site or its tools is limited, at our option, to:
- The amount paid by the user for Pro access; or
- Where no payment was made, the re-supply of the service.
4. Pro upgrade
A “Pro” upgrade is available as a one-time payment of $19 USD for lifetime access to premium features (PDF downloads and an ad-free experience) across all tools on the Site. Payment is processed by Stripe.
Refund policy: Given the digital nature of the product, refunds are at our discretion within 30 days of purchase where the service is not as described. Your statutory rights under the Australian Consumer Law are not affected.
5. Intellectual property
- The Site design, code, and written content (including explanatory articles and briefings) are owned by ToolkitHQ.
- User-entered data (such as invoice details) remains the property of the user.
- You may not copy, redistribute, or republish Site content without permission, except for personal, non-commercial use.
6. Third-party services
The Site uses third-party services that operate under their own terms:
- Cloudflare — CDN and analytics.
- Google AdSense — advertising on free-tool pages.
- Stripe — payment processing for Pro upgrades.
7. Disclaimer of warranties
The Site is provided “as is” without warranties of accuracy, availability, or fitness for a particular purpose, except for guarantees that cannot be excluded under Australian law.
8. Limitation of liability
To the maximum extent permitted by law, ToolkitHQ is not liable for indirect, consequential, or special damages arising from use of or reliance on the Site or its calculators. Total liability is capped as described in section 3 above.
9. Changes to these Terms
We may update these Terms from time to time. Material changes will be noted on the Site. Continued use after changes constitutes acceptance.
10. Termination
We may restrict access for breach of these Terms. You may stop using the Site at any time.
11. Governing law
These Terms are governed by the laws of Victoria, Australia. Disputes are subject to the exclusive jurisdiction of the courts of Victoria and, where applicable, the Federal Court of Australia.
